These terms of use for the platform are the terms of use governing the use of the Let's Role Platform (the "Terms of Use" or "TOU").
IMPORTANT
PLEASE READ THESE TERMS OF USE FOR THE LET'S ROLE PLATFORM CAREFULLY BEFORE USING IT (the "Platform"). THESE TERMS OF USE GOVERN YOUR ACCESS TO THE PLATFORM. YOU MAY ONLY USE THE PLATFORM IF YOU AGREE TO THE TERMS OF USE SET FORTH BELOW. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF USE, DO NOT USE THE PLATFORM. BY ACCESSINNG AND USING THE PLATFORM, YOU SIGNIFY YOUR AGREEMENT TO BE BOUND BY THE TERMS OF USE.
Preamble
LET'S ROLE has developed an innovative platform for online role-playing games in order to allow as many people as possible to enjoy the hobby : the PLATFORM.
LET'S ROLE operates the PLATFORM which can be accessed at the following URL address : https://lets-role.com
The present Terms of Use are concluded between :
- LET'S ROLE, a french société par actions simplifiée with a share capital of 2,000.00 euros, having its registered office located at 25 Allée Rose Dieng-Kuntz, 75019 Paris, immatriculée au Registre du Commerce et des Sociétés de Paris sous le numéro RCS 890 294 903.
Hereafter ("LET'S ROLE")
On the one hand,
AND
- THE USER,
Hereafter (the "USER")
On the other hand,
Hereinafter referred to individually as a "Party" and collectively as the "Parties".
ARTICLE 1 : DEFINED TERMS
ACCOUNT : refers to the USER's account on the PLATFORM necessary for access to it. The USER shall access the ACCOUNT by means of its LOGIN.
TERMS OF USE : means there terms of use governing the USER's use of the PLATFORM.
LOGIN : means the login and password for accessing the ACCOUNT. These identifiers are for the exclusive use of the USER, who is solely responsible for them.
PLATFORM : refers to the website https://lets-role.com as well as the role-playing platform hosted on the website.
LET'S ROLE : has the meaning given to in in the preamble of the present document.
USER(S) : refers to the user or users of the PLATFORM.
ARTICLE 2 : SCOPE OF APPLICABILITY
The purpose of these TOU is to define the contractual provisions relating to the respective rights and obligations of LET'S ROLE and the USERS as it concerns the PLATFORM's use.
All USERS of the PLATFORM acknowledge that they have read these TOU and accept them without reservation. Thus, the USER undertakes to read these TOU when using the PLATFORM for the first time and is invited to download them, print them and keep a copy. The USER undertakes to do so whenever the TOU are updated.
Any registration as a USER, by creating an ACCOUNT, requires the formal acceptance of these TOU.
ARTICLE 3 : TECHNICAL SPECIFICATIONS
To access the PLATFORM, the USER must have equipment with at least the following specifications: an up-to-date version of Google Chrome or an up-to-date version of Firefox.
ARTICLE 4 : USE OF THE ACCOUNT
The creation of an ACCOUNT allows USERS to access the PLATFORM.
The products offered by the PLATFORM are governed by the Terms of Sale that LET'S ROLE can communicate to any interested USER, upon request at the following address : help@lets-role.com
- Creation of an ACCOUNT
The USER wishing to open an ACCOUNT on the PLATFORM registers to it, free of charge, by filling in the registration form accessible via the "Registration" tab of the PLATFORM.
To open an ACCOUNT, each USER must provide the following information (the elements marked with an asterisk are mandatory for the registration to be validated) :

e-mail address* ; and

Country of residence*.
In order to create an account, the USER shall confirm the he/she has read and accepted these TOU.
After completing and validating this form, LET'S ROLE will activate the USER's ACCOUNT and the USER's data will then be recorded in the USER's account on the PLATFORM.
The USER may make any comments and/or ask any questions concerning the use of the PLATFORM to LET'S ROLE by contacting the customer service department at the following address :
- Account management
It is the USER's responsibility to ensure the confidentiality of his or her LOGIN's password. Any connection to the USER's ACCOUNT will be presumed to have been made by the USER himself.
As such, the USER shall be responsible for any action carried out through this ACCOUNT.
In the event of an unauthorized use of his ACCOUNT or in the case of suspicion of a fraudulent use, the USER undertakes to contract LET'S ROLE as soon as possible by e-mail at the following address :
The USE may make any comments and/or ask any questions concerning the use of the PLATFORM to LET'S ROLE by contacting customer service at the following address : help@lets-role.com
In the event of a breach of these TOU or the general covenant of loyalty, LET'S ROLE reserves the right to suspend or cancel the USER'S ACCOUNT, without prior notice.
- Deletion of the account
The USER is free at any time to delete his or her ACCOUNT in the following manner :
The USER goes into the "my account" tab and selects "delete my account".
The USER will then have to type "delete" and confirm the request.
LET'S ROLE will confirm the USER's deletion by sending an e-mail to the address indicated on his or her ACCOUNT.
All data and content related to this ACCOUNT will then be deleted from the PLATFORM, within (10) ten calendar days, unless otherwise requested by the USER via an e-mail at the help@lets-role.com address or in accordance with applicable regulations.
The USER acknowledges that all deletion request will have as a consequence the deletion of the data linked to the ACCOUNT, most importantly and most notably the LET'S ROLE products linked to the ACCOUNT, which the USER will lose access to DEFINITELY in case of the deletion of the ACCOUNT.
ARTICLE 5 : OBLIGATIONS OF THE PARTIES
5.1 : Obligations of the USER
When using the PLATFORM, each USER undertakes to comply with the provisions of these TOU and in particular to :
Use the PLATFORM for the purposes described in these TOU ;
Not infringe on the rights of third parties and respect the privacy of third parties and the confidentiality of exchanges and conversations ;
Not use the PLATFORM to send messages, or insert content on the PLATFORM that would be :
Contrary to public order and morality ;
Insulting, defamatory, racist, xenophobic, revisionist or damaging to the honor or reputation of others ;
Inciting discrimination, hatred of a person or group of persons because of their sexual orientation, political opinions, ethnicity, nationality, race or a particular group of persons ;
Threatening to a person or group of persons ;
Of a pedophilic or pornographic nature ;
Undermining the security or integrity of a State or territory, inciting to commit a crime or an act of terrorism or advocating war crimes or crimes against humanity ;
Inciting to suicide or self-harm ;
Of a commercial nature (prospecting, solicitation, prostitution, etc.) ;
Not disseminate data that would diminish, disrupt, slow down or interrupt the normal operation of the PLATFORM ;
Not violate or attempt to violate the security or integrity of the PLATFORM, communicate any misleading information, use information collected via the PLATFORM for illegal purposes ;
Not perform any qualitatively or quantitatively substantial extractions of data, including data mining or data collection operations aimed at LET'S ROLE ;
Not attempt to commit any act infringing on third parties, by any means whatsoever ;
Not misuse the purpose of the PLATFORM to commit crimes, offences or infractions punishable by any law :
Not attempt to undermine the automated processing of data.
- Obligation of LET'S ROLE
The general obligation of LET'S ROLE in the context of the PLATFORM is an obligation of means, and USERS acknowledge that it has no obligation of result or reinforced means of any kind.
LET'S ROLE undertakes to do everything in its power to ensure the continuity of access to and use of the PLATFORM, 7 days a week and 24 hours a day.
However LET'S ROLE draws the USERS' attention to the fact that current internet communication protocols do not allow for the continuous transmission of electronic exchanges (messages, documents, identity of the sender of recipient).
ARTICLE 6 : LIABILITY
- Responbility of LET'S ROLE
LET'S ROLE accepts no responsibility:

In the event of temporary impossibility of access to the PLATFORM (due to maintenance operations or updating of the PLATFORM);

In the event of a computer attack, in particular an intrusion into its information systems or data theft;

In case of abnormal or illegal use of the PLATFORM, the USER being in these cases the only one responsible for the damage caused to the third parties and the legal consequences of all claims or actions which can result from it;

In case of misuse of the PLATFORM by a USER, which would cause any damage to any other USER or third party;
-
In case of violation of these TOU.
- USER'S liability
The USER undertakes to comply with these TOU.
The USER is solely responsible for any damage, direct or indirect, material or immaterial, cause by him/her to other USERS, to LET'S ROLE or to any third party as a result of his/her use of the PLATFORM. LET'S ROLE declines all responsibility in this respect, particularly when the cause of the damage is a breach of these TOU.
ARTICLE 7 : INTELLECTUAL PROPERTY
- Intellectual property rights of LET'S ROLE
The trademarks, logos, slogans, graphics, photographs, animations,
videos, databases and texts contained on the PLATFORM, other than those
published by USERS, are either (i) the exclusive property of LET'S
ROLE, or (ii) are the subject of a license or other valid agreement
granted to LET'S ROLE by a third party, and may not be reproduced, used
or represented without permission.
The same applies to the underlying computer developments, technologies
and developments that make up the PLATFORM. They may not be reproduced,
decompiled or disassembled.
7.2 Respect of intellectual property rights by USERS
Total or partial reproduction of the content of the PLATFORM by any means whatsoever is prohibited and constitutes an infringement punishable by law.
LET'S ROLE prohibits USERS from:

Extracting, by permanent or temporary transfer of all the qualitatively or quantitatively substantial part of the content of the PLATFORM database onto another medium, by any means and in any form whatsoever;

Reusing, by making available to the public all of a qualitatively or quantitatively substantial part of the contents of the PLATFORM database;

The repeated and systematic extraction or reuse of qualitatively or quantitatively insubstantial parts of the contents of the PLATFORM database when such operations clearly exceed the normal conditions of use of this database. In this respect, the USER undertakes not to use any content of the PLATFORM, except for the authorizations granted herein.
ARTICLE 8 : PROTECTION OF PERSONAL DATA -- Data processing of LET'S ROLE as a data controller
LET'S ROLE may collect personal data necessary for the operation of the PLATFORM via the latter.
This data, which is necessary for the proper management of the PLATFORM and its operation, will be processed in accordance with the purpose for which it was collected.
LET'S ROLE also processes USERS' data for the improvement of its PLATFORM and its development activities.
LET'S ROLE has appointed a Data Protection Officer (DPO) to ensure compliance with its privacy policy and to draw up and maintain a register of all its personal data processing.
The USER has the right to access, rectify, oppose and delete his or her personal data.
The USER also has the right to withdraw his consent at any time.
The USER has the right to restrict the processing of his personal data and the right to portability of the data he has provided.
Finally, the USER has the right to define the consequence of his death on the data.
These rights can be exercised by sending a request by e-mail to the address: help@lets-role.com or by mail to the following address 11, Rue du Cambrai, Immeuble l'Artois, CS 90042 CEDEX, 75947 PARIS CEDEX 19, indicating his contact information (name, first name, address) and a legitimate reason if required by law (in particular in case of opposition to the processing).
In addition, the USER has the possibility of lodging a complaint with the CNIL (Commission Nationale Informatique et Libertés), the competent supervisory authority for personal data, in the event of a violation of his or her rights.
USERS undertake to comply with all legal provisions relating to the protection of personal data by LET'S ROLE, the USER may consult LET'S ROLE privacy policy.
ARTICLE 9 : MODIFICATIONS
These TOU apply to all USERS of the PLATFORM.
LET'S ROLE may, at any time, in particular in order to adapt to legislative and regulatory changes, be required to modify these TOU.
In this respect, the applicable TOU at any time are the TOU in force at the time of use of the PLATFORM.
ARTICLE 10 : CLAIMS
LET'S ROLE remains at the disposal of USERS and encourages them to contact LET'S ROLE to remedy any problem and make any claim at the following address : help@lets-role.com or by mail at the at the following address 11, Rue du Cambrai, Immeuble l'Artois, CS 90042 CEDEX, 75947 PARIS CEDEX 19.
ARTICLE 11 : GENERAL PROVISIONS
The present TOU represent the sole agreement and the only obligations between LET'S ROLE and the USERS and no document may give rise to an additional obligation not provided for in these TOU unless a new agreement is reached between LET'S ROLE and the USER.
The fact that the USER or LET'S ROLE has not demanded that a specific clause in the TOU be used may in no way be considered as a waiver of the said clause, the duration of the non-application of the clause being without effect.
In case of difficulty of interpretation between the titles appearing at the head of each clause and the clauses themselves, the titles will be declared non-existent and only the content of the clause will prevail.
If one of the dispositions of a clause in these TOU were to be declared null and void as a result of a legislative or regulatory shift and/or a court decision having the authority of res judicata, it would be deemed unwritten but would not affect the validity of other clauses, which would remain applicable.
ARTICLE 12 : COMPETENT JURISDICTION AND APPLICABLE LAW
These TOU and the relations between USERS and LET'S ROLE are governed by French law and any dispute will be submitted to the competent jurisdiction of the court of appeal of Paris, to which express attribution of jurisdiction is made.
Prior to any legal action, good faith negotiation must be privileged in order to try to reach an agreement between Parties, whether the dispute is related to the applicable of the TOU or their validity.
Before taking any legal action against the other Party, LET'S ROLE and the USER must attempt to reach an amicable agreement within one (1) months of the notice of such matter to one of the Parties by the other Party by means of a registered letter with acknowledgement of receipt.
